These Terms and Conditions of Use (Terms) apply to your access and use of the My Water platform.
The My Water platform provides electronic access to the Victorian Water Register for registered users. It is managed and governed by the Department of Energy, Environment and Climate Action (DEECA). My Water includes features to view allocation accounts, trade water allocation, lodge selected applications and submit various bore related applications. It also includes the Broker Portal, which provides additional functionality for approved water market intermediaries.
1.1 Any person who accesses and uses My Water is deemed to have accepted these Terms so please read them carefully.
2.1 In these Terms:
(a) Allocation Account (ABA) means an allocation account recorded in the Victorian Water Register.
(b) Authorised Agent means a person authorised by the holders of an Allocation Account to act on their behalf in relation to water allocation trading and to access My Water, where that authority has been granted through a properly executed Form 39a and recorded in the Victorian Water Register.
(c) DEECA means the Department of Energy, Environment and Climate Action (State of Victoria).
(d) My Water means the online platform that provides electronic access to the Victorian Water Register, enabling registered users to view their accounts and trade water allocation online, and includes the Broker Portal.
(e) The Water Register means the public register of all water-related entitlements in Victoria. It records water entitlements with integrity and provides crucial information for managing Victoria’s water resources under Victorian law.
3.1 Individual user accounts: All access to My Water must occur via a uniquely identifiable individual user account. Each user is responsible for actions performed under their account.
3.2 Prohibition on generic user accounts: Use of generic, shared, or non-uniquely identifiable individual accounts is strictly prohibited.
3.3 Keep credentials secret: You must keep your username, password, and security MFA codes, private and secure. Do not share them with any person, including family members, intermediaries, colleagues, advisors, or DEECA staff. DEECA will never ask for your password or security MFA codes. If someone else accesses My Water using your account details, then you may also be responsible for use of My Water by that person unless you have notified us (see 4.1).
3.4 Password security: Use a unique password for My Water that is easy to remember but hard to guess, avoids personal details (names, birthdays, account numbers), and is not reused on any other site or service. Passwords must have at least one number, one special character, and be at least 8 characters in length. Five incorrect entries of a password on login will lock a user out and require a password reset.
3.5 Multi-factor authentication (MFA): Access to My Water requires multi-factor authentication. Each time you access the My Water portal, a one-time verification code will be sent to the email address associated with your username. This code must not be shared.
3.6 Device and network protection: Keep your devices updated and protected (operating system patches, antimalware, screen locks). Logout when finished. Avoid shared/public computers for sensitive actions and don’t leave My Water open on an unlocked device. You should also avoid using unsecured public WiFi in accessing My Water.
3.7 Phishing: Be alert to unsolicited requests for your username and password credentials, financial information or MFA codes. DEECA will never ask you to reveal this information. If you suspect phishing, do not click any links or attachments and report immediately (see 4.1).
4.1 Report immediately: If you know or suspect your account, password, associated email address or MFA codes have been compromised, notice unauthorised login or activity emails, or detect phishing (see 3.7), fraud or any suspicious contacts that reference My Water, the Victorian Water Register or DEECA, you should immediately inform the Victorian Water Register support team at waterregister.support@deeca.vic.gov.au.
4.2 Our response: On receiving notification of a suspected or actual security issue or fraudulent activity, we may suspend or terminate access to My Water, restrict use of My Water, require credential resets, and request information from you to investigate the issue.
5.1 Legitimate use only: You must only use My Water for lawful purposes related to managing your water entitlements and transactions. You must not:
5.2 Broker Portal: Users of the Broker Portal are, in addition to these Terms, bound by the Water Register Interface Access Agreement, its Common Rules, and associated Instructions as found here.
6.1 Privacy: When you access My Water, personal information provided by you may be collected and handled by DEECA. If you have any questions in relation to the treatment of your personal information, or would like access to your personal information, please refer to the Victorian Water Register's privacy statement accessed here: https://waterregister.vic.gov.au/privacy.
7.1 No warranties: DEECA provides My Water to enable you to access government services. While DEECA will use reasonable endeavours to provide My Water, DEECA does not guarantee or provide any representations or warranties that the content or information on My Water (or your access to it) will be uninterrupted or error free, that any defects will be corrected, or that My Water or content are free of viruses or any other harmful components.
You acknowledge that My Water is provided on an "as is" and "as available" basis without warranties of any kind.
7.2 Liability: To the maximum extent permitted by law, DEECA, its employees and agents will not be liable, whether in contract, tort (including negligence) or otherwise for any economic loss, loss of profit, loss or reduction of goodwill, damage to reputation, loss of revenue, loss, destruction or corruption of data, or any other damages such, indirect, incidental, special, punitive, consequential or similar damages arising from or in connection with:
8.1 Protective security measures and monitoring: DEECA applies protective security measures consistent with the Victorian Protective Data Security Framework (VPDSF) to support the security and integrity of My Water and the Victorian Water Register. This may include monitoring and logging of system and account activity for security, operational, and compliance purposes.
8.2 Planned and unplanned outages: My Water may be unavailable from time to time due to planned maintenance, system updates, upgrades, or unplanned events beyond DEECA’s control. Where planned outages are expected to materially impact system availability, DEECA will use reasonable efforts to provide advance notice through the Victorian Water Register website or related communications.
8.3 System updates and feature changes: DEECA may add, modify, or remove system features, including security related features, to maintain compliance with legal, policy, or regulatory requirements, align with evolving guidance, or improve system performance and reliability.
8.4 Security related changes without notice: DEECA may implement security related changes, including changes to access controls or service availability, without prior notice where reasonably necessary to address a security risk, respond to a suspected or actual security incident, or comply with a legal or whole of government requirement.
9.1 Security alerts: We may send you security notifications (for example, password reset confirmations, policy changes). Keeping your contact details current is your responsibility.
9.2 News and changes: We will publish notice of significant security updates through Water Register news and related channels.
10.1 Authority to submit application: You may submit an online application to trade water allocation only in your capacity as an ABA holder or an authorised agent appointed by the holders of the seller’s ABA. By submitting an application, you confirm that you are acting strictly in accordance with the instructions of the ABA holders.
10.2 Submitting allocation trade applications:
10.3 Responsibility for accuracy and completeness: It is your responsibility to ensure all information provided is complete and correct. There are separate Commonwealth obligations that require trade application forms to be completed comprehensively and accurately. 10.4 Online system checks: My Water performs preliminary checks and may issue warnings if a trade is likely to be refused. These checks are indicative only and do not guarantee any given outcome. As information in the water register may change between submission and assessment (e.g., updated usage data or delays associated with interstate processing), approval outcomes may differ from initial system indications.
10.5 Notification of outcome: The authorised agent who submitted the application will receive the outcome by email. It is the responsibility of the authorised agent to communicate this outcome to the buyer, as set out in the email notification.
10.6 Allocation trade disclaimers: Approval of an allocation trade:
Approved trades result in the immediate transfer of allocation regardless of whether financial settlement has occurred.
11.1 Submitting bore construction and completion applications:
All bore construction licences are only valid for a period of 12 months from the date of approval.
11.2 Responsibility for accuracy and completeness: It is your responsibility to ensure that all information provided in a bore application or bore completion report is complete, accurate and correct at the time of submission.
In particular, you must ensure that:
Once submitted, bore completion records cannot be amended.
11.3 Notification of outcome
The user who submits the bore application will receive the outcome by email.
For Bore Completion Reports, submission does not constitute acceptance of the works; acceptance may only occur once the report has been reviewed and processed.
12.1 Changes to Terms: These Terms may be varied at any time. Updated Terms will be published on the Victorian Water Register website. Continued use of My Water after the effective date of any variation constitutes acceptance of the revised Terms.
13.1 Governing law: These Terms are governed by and are to be construed in accordance with the Laws of the State of Victoria.
13.2 Governing jurisdiction: Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of Victoria and any courts which have jurisdiction to hear appeals from any of those courts and waives any right to object to any proceedings being brought in those courts.
